2018 National Training - Case Law Update Session: Article: "The Gratuity Theory of Pensions and Faux Church Plans"

Client had worked for the employer in both salaried and hourly positions. The company sponsored the salaried plan, and a multiemployer plan covered the client's work in the hourly position. This was a claim for benefits under the salaried plan, which successfully argued that all the time in union employment had to be counted toward vesting the the company-sponsored salaried plan pursuant to ERISA 203(b)(1).

Claim for survivor's benefits. Client's spouse had worked only through 1976. He had reached Normal Retirement Age in 1996 but never applied for his benefits and died in 2010. When client contacted plan, she was told that because he never applied for his pension, there was no benefit for her. We argued that because he was alive and not yet in pay status on August 23, 2984 (date of REA enactment), she had automatic survivor benefit pursuant to REA and its transitional rules. Claim was successful.
