On August 9, 2016, client (who speaks Spanish and does not speak or read English) and her husband completed benefit election paperwork(in English, although this plan has all of its materials available in Spanish also and did not provide to her. Husband elected single-life annuity and client waived her right to a survivor benefit. Husband died suddenly and unexpectedly the day after the paperwork was completed. Client went into the fund osffice a few weeks later and tried to revoke her consent, but plan would not allow her to. She came to us and we argued that the plan had to pay her based on (1) her right to revoke; (2) the fact that because her husband had not lived to annuity start date, she had automatic right to pre-retirement survivor benefit; and (3) plan's breach of fiduciary duty in giving her English-only forms. The plan issued a decision agreeing that she had the right to revoke, and agreeing to pay her the 50% J &S
