This claim which we called an amended claim in order to preserve our right to appeal was submitted after the plan gave us an inadequate denial from our initial claim. After speaking with the plan administrator, we amended the claim to address their new accusations that not only did they not owe our client any additional benefits, but that she had in fact been overpaid and owed the plan money. They argued that our client was never a full time employee of the sponsoring employer rather she was a part-time employee for two separate businesses despite the fact that she sat at the same desk and performed the same job function regardless of who paid her. After doing some research we also discovered that there were several entities incorporated in several different states and one in a Carribbean country. The plan quickly gave in to our claim for benefits after receiving this amended claim.

This memo analyzes a case where the client worked past Normal Retirement Age (NRA) and past age 70 and a half which is generally the required minimum distribution (RMD) age. The plan incorrectly calculated the client's benefits by not giving him an actuarial increase to account for the suspension of benefits when he worked past the RMD date. The client was difficult and insisted he was entitled to a lump sum for benefits all the way back to age 65 under an anti-cutbackrule theory. The memo explains why the client's argument fails, but unfortunately the client refused to accept this.
